2. Purpose and scope of application.

The purpose of these General Terms and Conditions of Contract and Use is to regulate the provision of information provided in the online store at www.feisbook.es, as well as the commercial transactions that arise between BUY GOLF SPAIN SL and the users of the domain www.feisbook.es. Both browsing the online store and the purchase of any of the products offered therein imply acceptance, as a user, without reservation of any kind, of each and every one of these general terms and conditions of contract and use. 9. Shipping costs.

Shipping costs are free for orders over €50 (mainland Spain only) and from €4.99 (VAT included) for smaller orders.

For shipments to the Balearic Islands, the Canary Islands, Ceuta and Melilla, and to countries within the European Union, shipping costs will be determined based on the volume of the item(s) purchased.

 

10. Placing the order

To place an order, you must log in to www.comprargolf.com and register as a user by completing the electronic form that appears in the store at any time and following the instructions therein. After registering, and to proceed with the purchase of products, you must add the product you wish to purchase to your shopping cart, following the instructions on the screen, completing the order form provided for this purpose, and validating it. It is essential that the information on the form is correct, since BUY GOLF SPAIN SL will reproduce the text exactly as written, without modifying letters, capital letters, punctuation marks, etc. All specifications and other details that the buyer requests for the product must be provided at the time of placing the order. If the customer does not specify their customizations, BUY GOLF SPAIN SL will select the default details, and the customer may not refuse them. BUY GOLF SPAIN SL will not be obligated to request missing information from the customer for the manufacturing of the product. However, BUY GOLF SPAIN SL may, if it detects an error, contact the customer at the email address provided in the form to request clarification of any missing information. In this case, the delivery period will be suspended and will resume when the customer responds to the request made by BUY GOLF SPAIN SL. If, in the above case, and after 60 days have passed since BUY GOLF SPAIN SL requested additional information, the buyer does not respond, the order will be considered canceled, and the price will not be refunded.

Once the customer places the order, including all the details and specifications they desire, and has paid the price, thus validating the purchase order, no changes will be accepted.

The customer's validation of the order expressly implies acknowledgment and acceptance of these general terms and conditions as part of the contract. Unless proven otherwise, the data recorded by BUY GOLF SPAIN SL constitutes proof of all transactions between BUY GOLF SPAIN SL and its customers. BUY GOLF SPAIN SL will archive the electronic document formalizing the contract, which will be accessible. Once the purchase is made, the user will receive an order confirmation by email, including the purchase invoice.

 

11. Right of Withdrawal and Returns

If for any reason you are not satisfied with the product you purchased , you can return it to us within 14 calendar days of shipping, and we will exchange it for another product or refund your money. We do not accept returns on engraved or personalized products such as clubs, balls, bags, or any other items that may have been purchased with specific customization.

Only returns authorized by BUY GOLF SPAIN SL will be accepted. To request this authorization, the customer must notify BUY GOLF SPAIN SL by email at gestion@buygolfspain.com within the stipulated period of their wish to exercise their right to withdraw from the contract, indicating the item(s) they wish to return and the order number or reference in which they were included when purchased.

If the return is accepted, the customer will receive instructions on how to make the return and to what address(es) the item(s) to be returned should be sent.

Once the merchandise has been received and verified to be in perfect condition, the purchase price will be refunded or a new product, consisting of the same item, will be sent, if the customer so desires.

BUY GOLF SPAIN SL reserves the right to refuse a return or to pay a lower amount if the item does not arrive in proper condition (condition, packaging, etc.).
If the product does not match the order or purchase, BUY GOLF SPAIN SL will be responsible for the shipping and return costs, as well as for the replacement product. If the buyer is responsible for errors or inconsistencies in the order placement, the buyer will be responsible for all return shipping costs.

12. Withdrawal

You have the right to withdraw from this contract within 14 calendar days without giving any reason. The withdrawal period will expire 14 calendar days after the day on which you or a third party other than the carrier indicated by you acquires physical possession of the goods.

To exercise your right of withdrawal, you must notify BUY GOLF SPAIN SL - Customer Service Department, RAMBLA MENDEZ NUÑEZ Nº 23, 2º B (03002 – ALICANTE) or by sending an email to gestion@buygolfspain.com , of your decision to withdraw from the contract. You may also make an unequivocal declaration of your decision by means of a letter sent by post using the withdrawal form, although its use is not mandatory. To comply with the withdrawal deadline, it is sufficient for you to send your communication regarding your exercise of this right before the corresponding deadline expires.

Model withdrawal form:

If you withdraw from this contract, we will refund all payments received from you (excluding shipping costs, if applicable) without undue delay and in any event no later than 14 calendar days from the date on which we are informed of your decision to withdraw from this contract. We will process the refund using the same payment method you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of the refund.

In this case, shipping costs will be borne by the customer. We are not responsible for packages that do not arrive due to loss or other reasons. Therefore, we recommend using certified mail or a courier service that can certify delivery.

To be eligible for a return, both the product and its packaging must be in perfect condition, free of scratches, broken, or damaged packaging, and must include all accompanying documentation and accessories. The customer must ensure proper packaging to ensure undamaged shipment. Once the product has been received and verified by our staff to be in the same condition as when it was sent, a refund will be issued.

14. Product availability and shipping times.

The selection of products offered at www.comprargolf.com is valid as long as the products are visible on the website, within the limits of available stock. The delivery time is indicated on each product page. If the merchandise is in stock, shipping will take place on the next business day and is expected to be delivered within 24 to 48 hours. If, on the other hand, we do not have stock, we will place a request with the supplier, estimating a delivery time of approximately 10 to 12 business days.

15. Payment

BUY GOLF SPAIN offers two payment methods so you can choose the one that best suits your needs:

Payment by Credit Card: You can use Visa or MasterCard. If you pay with a VISA or Mastercard, if the POS indicates the card is declined, the order will be automatically canceled, and the customer will be notified online of the cancellation. For payments made with cards issued outside of Spain, the issuing bank must be compliant with the Secure Electronic Commerce (CES) Security Protocol. Payments with cards that do not meet this requirement will not be accepted.

Payment by bank transfer: You can make your payment by bank transfer. This must be completed within a maximum of 5 days. Otherwise, we will consider it a withdrawal from the purchase. Once the transfer is effective, the order will be processed.

16. Consumer Goods Warranty

In accordance with the General Law for the Defense of Consumers and Users and other complementary laws, all BUY GOLF SPAIN SL products have a two-year warranty from delivery, and we will proceed, as appropriate, to repair, replace, reduce the price, or refund the product. If you need to make a warranty claim, please contact us by email at gestion@buygolfspain.com. This warranty does not cover possible breakage or wear caused by use. The consumer and user must inform the seller of any lack of conformity within two months of becoming aware of it.

17. Applicable legislation. Submission to jurisdiction.

Sales made on www.facebook.es are subject to Spanish law. In the event of any conflict or dispute arising in the interpretation or application of these contractual conditions, the Courts and Tribunals that will hear the matter, if any, will be those provided for by the applicable legal regulations regarding competent jurisdiction. In the case of end consumers, the court of first instance will be the place of performance of the obligation or the domicile of the purchasing party.
